Microsoft Dynamics 365 Marketing and Canadian Anti-Spam Legislation (CASL)
Microsoft Dynamics 365 Marketing makes it very easy to implement GDPR, which is the European Union law on data protection and privacy; but, what about implementing CASL (Canadian anti-spam legislation) functionality in Microsoft Dynamics 365 Marketing?
I took a look at what it would take to adjust the GDPR functionality in order to implement CASL functionality and this is what I found:
Adjusting the data protection settings to work with CASL
Go to the settings area of the sitemap in your marketing app and create a data protection record.
Instead of naming the record with the conventional name that most people use of "Default GDPR settings", you can name your record "Default CASL settings".

Adjusting consent level settings to work for CASL
Microsoft Dynamics 365 Marketing has the following consent levels set to those that are applicable to GDPR.
Those out-of-the-box GDPR settings are as follows:
(0) - No consent
(1) - Consent
(2) - Transactional
(3) - Subscriptions
(4) - Marketing
(5) - Profiling
However, for a CASL implementation we would like the consent levels to be:
(0) - CASL opt-out
(1) - CASL opt-in implied
(2) - CASL opt-in express
In order to adjust this list of consent levels, you would need to adjust the following global option set:
You can name the content settings record as: Default content settings
Make sure to fill in your address and the link to the subscription center (i.e., the web page where people can subscribe and unsubscribe from any subscription lists you maintain or unsubscribe from all emails.
Most people use the out of the box subscription center page and modify it to include any subscription lists they may have, like the following:
Next, in the footer of your marketing emails you will want to reference content settings to show the address and the link to your subscription center, like this:
And finally, when you create a customer journey you will have to select the minimum consent level and which content setting record you want to use to supply the address and the subscription center link, like this:
